These Terms of Service (“Terms”) govern your access to and use of the Pool Pro’s Connect LLC website, CAD™ membership program, dashboard resources, consultations, educational materials, communications, affiliate opportunities, and all related PPC products, services, resources, and offerings.
By accessing, browsing, registering for, purchasing, subscribing to, communicating with, participating in, or otherwise using PPC services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as amended from time to time.
If you do not agree to these Terms, you must discontinue use of PPC services immediately.
For purposes of these Terms:
“CAD™” means Consult • Advise • Decide™, PPC’s educational, advisory, and decision-support framework designed to assist pool owners and customers in making informed decisions regarding pool ownership, equipment, maintenance, repairs, replacements, products, services, warranties, and related matters.
“Customer” means any visitor, member, subscriber, purchaser, user, participant, or other individual or entity accessing PPC services.
“Membership” means participation in PPC’s CAD™ membership program and associated resources, benefits, communications, and services.
“Consultation” means a one-time advisory interaction, discussion, review, communication, virtual interaction, educational interaction, or related service provided by PPC.
“Affiliate” means any affiliated entity, ecosystem participant, supplier, contractor, vendor, advertiser, sponsor, service provider, or future participant associated with PPC.
“Ecosystem” means the collective network of PPC, affiliated entities, suppliers, contractors, vendors, advertisers, sponsors, educational resources, and future participants.
PPC operates an educational, advisory, and decision-support platform.
PPC is designed to provide pool owners with information, educational resources, advisory services, equipment intelligence, observations, probable causes, recommendations, alternatives, decision-support resources, membership benefits, and related services intended to assist customers in making informed decisions.
Services may be provided through any communication method selected by PPC, including but not limited to:
• Website resources
• Dashboard resources
• Email communications
• Messaging communications
• Telephone communications
• Virtual consultations
• Photographs
• Videos
• Educational materials
• Written communications
• Future technology platforms
PPC reserves the right to modify, expand, reduce, suspend, discontinue, replace, or otherwise alter any service, feature, program, benefit, communication method, or platform at any time.
PPC is an advisory and decision-support platform.
PPC is not a contractor, subcontractor, project manager, construction manager, engineering firm, warranty company, insurance provider, emergency response service, purchasing agent, legal advisor, fiduciary, estimating service, proposal review service, contract review service, warranty interpretation service, bid-comparison service, code-enforcement authority, manufacturer, distributor, or retailer.
Any information provided by PPC is intended for educational, informational, advisory, and decision-support purposes only.
PPC does not provide engineering opinions, legal opinions, code-compliance determinations, inspections, certifications, guarantees, warranties, or assurances of any kind.
PPC does not guarantee the accuracy, completeness, suitability, reliability, effectiveness, performance, availability, or outcome of any information, recommendation, observation, conclusion, contractor, supplier, product, service, repair, installation, replacement, warranty, or other matter discussed.
PPC may offer annual memberships, subscription programs, educational programs, advisory programs, and related services.
Membership provides access to designated resources, benefits, communications, educational materials, dashboard functionality, equipment intelligence resources, and other services as determined by PPC.
Membership benefits may be modified, expanded, reduced, suspended, replaced, or discontinued at any time.
Membership grants access to PPC resources and services but does not create an unlimited consulting relationship, professional-services agreement, engineering engagement, legal engagement, contractor relationship, or other continuing obligation.
PPC retains sole discretion regarding the scope, nature, frequency, and availability of services provided to members.
Membership does not guarantee:
• Immediate responses
• Same-day responses
• Live support
• Telephone support
• Video consultations
• Specific communication methods
• Unlimited consultations
• Unlimited communications
• Unlimited reviews
• Unlimited evaluations
• Continuous availability
• Specific response times
PPC retains sole discretion regarding response timing, response methods, communication methods, scheduling, staffing allocation, resource allocation, operational priorities, workload management, and service availability.
PPC may determine, in its sole discretion, whether a request falls within normal membership support, requires additional information, requires a separate consultation, requires an enhanced consultation, requires a special project review, requires a paid service, or falls outside the scope of PPC services.
Memberships are annual unless otherwise specified by PPC.
Membership pricing, benefits, structures, and program requirements may change at any time.
Memberships do not automatically renew unless expressly stated otherwise by PPC.
Customers are solely responsible for renewing memberships prior to expiration.
No grace period shall apply unless expressly authorized by PPC.
Upon expiration, PPC may immediately suspend or terminate access to membership benefits, dashboard resources, communications, educational resources, records access, and other services.
PPC may offer one-time consultations separate from membership.
A consultation consists of a single advisory interaction, review, discussion, communication cycle, or educational interaction intended to address a specific customer inquiry.
Consultations may be conducted through photographs, videos, emails, messages, telephone communications, virtual communications, documentation review, or other communication methods selected by PPC.
A consultation concludes when PPC determines that information, observations, recommendations, alternatives, probable causes, guidance, educational information, or decision-support resources have been provided.
Upon conclusion, the consultation is deemed complete and closed.
No continuing obligation, continuing support obligation, follow-up obligation, ongoing review obligation, monitoring obligation, or future advisory obligation shall exist following closure of the consultation.
Any future assistance may require the purchase of a new consultation, enhanced consultation, special project review, membership enrollment, or other service designated by PPC.
PPC may offer a consultation credit program.
Customers purchasing a consultation may receive a credit applicable toward membership enrollment.
Such credit shall remain valid for seven (7) calendar days following the consultation date.
The credit shall expire automatically at 12:00 a.m. on the eighth day following the consultation.
Expiration of the credit shall be final.
Membership enrollment does not reopen, extend, revive, continue, or otherwise modify a previously concluded consultation.
The original consultation remains closed and complete regardless of subsequent membership enrollment.
Customers remain solely responsible for all decisions, actions, purchases, repairs, replacements, maintenance activities, contractor selections, supplier selections, budgeting decisions, warranty decisions, insurance decisions, safety decisions, and implementation of any recommendation, observation, suggestion, alternative, probable cause, educational information, or guidance provided by PPC.
Customers acknowledge that PPC does not control the customer’s property, equipment, contractors, suppliers, service providers, manufacturers, warranties, budgets, schedules, maintenance activities, repair activities, replacement activities, or operational decisions.
Customers are responsible for independently evaluating all information provided by PPC and determining whether such information is appropriate for their specific circumstances.
Customers assume all risks associated with reliance upon information, recommendations, observations, educational materials, probable causes, alternatives, guidance, and decision-support resources provided by PPC.
PPC relies substantially upon information supplied by customers.
Such information may include:
• Photographs
• Videos
• Equipment descriptions
• Serial numbers
• Equipment histories
• Customer observations
• Customer statements
• Emails
• Messages
• Documentation
• Other information supplied by the customer
Customers acknowledge that information supplied to PPC may be incomplete, inaccurate, outdated, misleading, misunderstood, improperly documented, incorrectly described, partially provided, altered, omitted, or otherwise insufficient.
Because PPC relies upon customer-supplied information, PPC cannot and does not guarantee the accuracy of any recommendation, conclusion, observation, probable cause, alternative, guidance, educational information, or decision-support resource derived from such information.
Customers acknowledge that undisclosed conditions, hidden defects, concealed conditions, improper installations, code violations, safety hazards, environmental conditions, operational issues, manufacturer defects, installation defects, maintenance deficiencies, and other material conditions may exist that are not visible or apparent through customer-provided information.
PPC may conduct consultations through photographs, videos, video conferencing platforms, messaging platforms, telephone communications, emails, screen sharing, virtual walkthroughs, remote observations, and similar communication methods.
Customers acknowledge that virtual consultations are inherently limited.
Photographs, videos, virtual consultations, video conferences, FaceTime sessions, remote observations, screenshots, customer walkthroughs, messaging exchanges, and related communications do not constitute:
• An inspection
• A site visit
• An engineering review
• A code review
• A safety certification
• A warranty determination
• A contractor evaluation
• A manufacturer evaluation
• An equipment certification
• A comprehensive evaluation
• A professional inspection
Virtual consultations may fail to reveal hidden defects, concealed conditions, safety hazards, code violations, structural issues, electrical hazards, gas hazards, water intrusion, underground conditions, environmental conditions, installation deficiencies, maintenance deficiencies, or other material conditions.
Customers remain responsible for obtaining appropriate on-site evaluations whenever necessary.
To the fullest extent permitted by applicable law, customers consent to PPC documenting, recording, summarizing, retaining, reviewing, analyzing, storing, and utilizing communications and consultations for operational purposes.
This authorization may apply to:
• Telephone communications
• Video consultations
• Messaging communications
• Emails
• Uploaded photographs
• Uploaded videos
• Dashboard communications
• Consultation notes
• Customer records
PPC may utilize such records for quality assurance, training, operational purposes, safety documentation, dispute resolution, historical records, service improvement, platform improvement, recordkeeping, legal compliance, and business continuity purposes.
Customers retain ownership of photographs, videos, messages, communications, documentation, and other materials submitted to PPC.
However, by submitting such materials, customers grant PPC a perpetual, non-exclusive, royalty-free license to store, review, analyze, reproduce internally, maintain, archive, document, retain, and utilize such materials for operational purposes.
PPC may maintain such materials as part of customer records, equipment records, consultation records, historical records, safety records, dispute-resolution records, business records, and platform records.
PPC will not intentionally disclose customer-submitted content to unrelated third parties except:
• With customer authorization
• As required by law
• To protect rights, safety, or property
• As otherwise disclosed within PPC policies
Affiliated entities do not automatically receive customer-submitted content absent customer authorization or other disclosed circumstances.
PPC is not an emergency response service.
PPC does not provide emergency monitoring, emergency dispatch, emergency repair services, emergency response services, emergency engineering services, emergency safety inspections, or emergency intervention services.
Customers remain solely responsible for identifying, evaluating, monitoring, and responding to emergency conditions.
Emergency conditions may include, without limitation:
• Gas leaks
• Electrical hazards
• Fire hazards
• Flooding
• Structural failures
• Equipment failures
• Water loss
• Utility hazards
• Safety hazards
• Health hazards
• Environmental hazards
• Any condition presenting immediate risk
If PPC identifies or believes a safety concern may exist, PPC may provide observations, warnings, recommendations, or educational information. However, PPC assumes no duty to identify, discover, monitor, detect, investigate, prevent, eliminate, correct, or respond to emergency conditions.
Failure by PPC to identify a condition shall not create liability.
PPC consultations are limited to educational, informational, advisory, and decision-support services.
PPC does not provide:
• Legal advice
• Engineering advice
• Architectural advice
• Code-compliance determinations
• Contract review services
• Proposal review services
• Warranty interpretation services
• Estimating services
• Bid-comparison services
• Litigation support
• Expert-witness services
• Regulatory compliance services
PPC may discuss general concepts relating to such subjects but does not provide professional services within those fields.
PPC’s obligation is satisfied when PPC provides information, guidance, educational content, recommendations, observations, probable causes, alternatives, decision-support resources, or related communications.
PPC is not responsible for whether a customer:
• Follows advice
• Ignores advice
• Misunderstands advice
• Partially follows advice
• Delays action
• Rejects recommendations
• Modifies recommendations
• Implements recommendations incorrectly
• Acts contrary to recommendations
All actions, implementations, purchases, repairs, maintenance decisions, contractor selections, supplier selections, budgeting decisions, and outcomes remain solely the responsibility of the customer.
PPC may identify, display, reference, advertise, discuss, list, recommend, provide access to, or otherwise make available contractors, suppliers, vendors, service providers, advertisers, sponsors, affiliates, and ecosystem participants.
PPC does not guarantee:
• Availability
• Participation
• Acceptance of work
• Scheduling
• Response times
• Geographic coverage
• Licensing status
• Insurance status
• Qualifications
• Pricing
• Workmanship
• Future performance
• Continued participation
Contractors, suppliers, vendors, affiliates, and ecosystem participants may join, leave, become unavailable, change services, change territories, change pricing, change business models, suspend operations, discontinue products, or cease participation without notice.
Customers remain solely responsible for evaluating and selecting contractors, suppliers, vendors, products, services, and providers.
PPC may display, advertise, discuss, reference, promote, provide access to, or otherwise make available information relating to products, equipment, services, suppliers, contractors, promotions, affiliate opportunities, educational resources, member benefits, preferred placement opportunities, special programs, and related offerings.
All product information, pricing information, promotional information, affiliate opportunities, member benefits, and related materials are provided for informational purposes only.
PPC does not guarantee:
• Product availability
• Inventory availability
• Pricing accuracy
• Promotional availability
• Shipping availability
• Manufacturer availability
• Supplier availability
• Future pricing
• Future promotions
• Future discounts
• Future member benefits
PPC reserves the right to modify, suspend, withdraw, discontinue, correct, replace, revise, or remove any product information, pricing information, promotion, affiliate opportunity, member benefit, educational offering, preferred placement opportunity, or special program at any time without notice.
PPC may participate in affiliate programs, referral programs, sponsorship arrangements, advertising programs, preferred placement programs, ecosystem participation programs, compensation programs, and similar business arrangements.
PPC may receive compensation directly or indirectly through:
• Affiliate relationships
• Advertising arrangements
• Sponsorship arrangements
• Referral programs
• Preferred placement arrangements
• Click-through arrangements
• Member-benefit programs
• Ecosystem participation programs
• Future compensation arrangements
Compensation may be received from affiliated entities, suppliers, contractors, vendors, advertisers, sponsors, service providers, manufacturers, distributors, ecosystem participants, and future participants.
Customers acknowledge that affiliate relationships may exist within the PPC ecosystem.
Customers are under no obligation to utilize any contractor, supplier, vendor, affiliate, service provider, advertiser, sponsor, ecosystem participant, or affiliated entity identified, displayed, referenced, advertised, promoted, recommended, or otherwise made available through PPC.
Customers remain free to:
• Select any contractor
• Select any supplier
• Select any vendor
• Purchase products from any source
• Obtain competing estimates
• Obtain competing proposals
• Utilize competing services
• Select any service provider of their choosing
Final decisions remain solely the responsibility of the customer.
PPC shall not be responsible or liable for any delay, interruption, outage, inaccuracy, failure, inability to perform, loss of data, communication failure, scheduling failure, customer impact, business impact, or other consequence arising from events beyond PPC’s reasonable control.
Such events may include, without limitation:
• Internet outages
• Telephone outages
• Cellular outages
• Utility failures
• Power failures
• Hosting failures
• Software failures
• Platform failures
• Vendor failures
• Supplier failures
• Manufacturer actions
• Distributor actions
• Affiliate actions
• Independent contractor actions
• Third-party service failures
• Cyberattacks
• Ransomware events
• Data breaches
• Security incidents
• Natural disasters
• Fire
• Flood
• Earthquake
• Severe weather
• Public emergencies
• Public health events
• Labor disruptions
• Strikes
• Civil unrest
• Terrorism
• War
• Military actions
• Regulatory changes
• Government actions
• Law changes
• Policy changes

• Insurance changes
• Supply-chain disruptions

• Any other event beyond PPC’s reasonable control
PPC shall not be liable for the actions, inactions, decisions, omissions, policies, procedures, pricing changes, availability changes, business decisions, operational decisions, or performance of any third party.
PPC reserves the right, at any time and in its sole discretion, to:

• Modify services
• Suspend services
• Replace services
• Expand services
• Reduce services
• Add membership programs
• Modify membership programs
• Add membership tiers
• Modify membership tiers
• Add consultation programs
• Add educational programs
• Add employees
• Add advisors
• Add contractors
• Add suppliers
• Add vendors
• Add affiliates
• Add ecosystem participants
• Add technologies
• Modify technologies
• Change pricing
• Change benefits
• Change operational procedures
• Change business structures
Customers acknowledge that PPC is an evolving platform and that services may change over time.
Customers acknowledge that information provided by PPC may contain:
• Errors
• Omissions
• Inaccuracies
• Incomplete information
• Incorrect assumptions
• Incorrect conclusions
• Outdated information
• Inapplicable information
• Misinterpretations
PPC makes no representation or warranty regarding the accuracy, completeness, reliability, suitability, applicability, usefulness, effectiveness, or correctness of any information provided.
Customers assume all responsibility for independently evaluating information prior to taking action.
To the fullest extent permitted by law, customers agree to defend, indemnify, and hold harmless PPC, its affiliates, officers, directors, managers, employees, representatives, advisors, contractors, vendors, service providers, successors, and assigns from and against any and all claims, demands, damages, liabilities, losses, expenses, costs, penalties, fines, judgments, settlements, and attorney fees arising from or related to:
• Customer actions
• Customer decisions
• Customer purchases
• Customer communications
• Customer submissions
• Customer property
• Customer equipment
• Contractor relationships
• Supplier relationships
• Product purchases
• Service purchases
• Reliance upon PPC information
• Use of PPC services
• Violation of these Terms
TO THE FULLEST EXTENT PERMITTED BY LAW, PPC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES.
THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND REGARDLESS OF WHETHER PPC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
CUSTOMERS ACKNOWLEDGE THAT USE OF PPC SERVICES IS VOLUNTARY AND AT THEIR OWN RISK.
PPC reserves the right to suspend, restrict, terminate, refuse, or revoke access to any customer for any conduct PPC determines to be abusive, threatening, disruptive, harassing, fraudulent, dishonest, harmful, inappropriate, unsafe, unlawful, or otherwise inconsistent with PPC’s business operations, values, policies, or objectives.
PPC reserves the right to refuse future services, memberships, consultations, communications, or participation within the PPC ecosystem.
PPC reserves the right to modify these Terms at any time.
Updated Terms shall become effective upon publication or other notice provided by PPC.
Continued use of PPC services following publication of revised Terms constitutes acceptance of the revised Terms.
If any provision of these Terms is determined to be invalid, illegal, unenforceable, or otherwise ineffective, the remaining provisions shall remain in full force and effect.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
